I just got EU settled status, can I apply for British citizenship now?

No, you need to wait 12 months. EU settled status is treated the same as Indefinite Leave to Remain (ILR) for citizenship purposes. You must hold it for at least 12 months before you can apply for British citizenship.

The only exception is if you are married to or in a civil partnership with a British citizen — in that case, you can apply immediately.

Why can't I apply straight away?

Settled status under the EU Settlement Scheme is legally equivalent to ILR. The Home Office requires all ILR holders to wait 12 months before applying for citizenship to demonstrate settled commitment to living in the UK. This rule applies regardless of how long you've actually been living here.

So even if you've been in the UK for 10 or 15 years as an EU citizen, once you receive settled status, the 12-month clock only starts from the date it was granted — not from when you first arrived.

What if I was automatically converted from pre-settled status?

Since January 2025, the Home Office has been automatically converting eligible pre-settled status holders to settled status. If you received an email confirming your automatic conversion, your 12-month waiting period starts from the date settled status was granted through that conversion.

This is actually good news for many EU nationals — the automatic conversion removes the need to submit a manual application, and your 12-month countdown begins as soon as the conversion is confirmed.

The spouse exception

If you are married to or in a civil partnership with a British citizen, you do not need to wait 12 months. You can apply for citizenship as soon as you have settled status, provided you meet all other requirements.

For spouses, the residency requirement is also shorter: 3 years of UK residence instead of 5 years, with no more than 270 days absent (instead of 450 days) and no more than 90 days absent in the final year.

Full requirements for EU nationals applying for citizenship

After holding settled status for 12 months, you must also meet these requirements:

  • 5 years of continuous UK residence — and you must have been in the UK exactly 5 years before the date the Home Office receives your application
  • Absence limits — no more than 450 days outside the UK in the 5-year qualifying period, and no more than 90 days in the final 12 months
  • Good character — no serious criminal convictions, tax irregularities, or immigration violations
  • Life in the UK test — you must pass this if you haven't already
  • English language — demonstrated at B1 level or higher (EU nationals from English-speaking countries or with UK degrees may be exempt)
  • Intent to live in the UK — or maintain close connections with the UK

What about the residency requirement for EU citizens specifically?

As an EU citizen who started living in the UK before 31 December 2020, your qualifying period may include time spent under EU free movement rules before you formally applied for settled status. The key is that you can demonstrate 5 years of continuous, lawful residence in the UK.

The Home Office will check that during those 5 years, you were exercising your EU treaty rights: working, self-employed, studying, or self-sufficient. Your EU Settlement Scheme application would have already verified much of this.

The application process

Once you're eligible, the process is:

  1. Apply online through the Home Office website (fee: £1,630)
  2. Attend a biometric appointment at a UKVCAS centre
  3. Wait for a decision — typically 3 to 6 months
  4. Attend a citizenship ceremony within 3 months of approval
  5. Apply for your British passport once you have your certificate of naturalisation

Don't apply too early

The £1,630 application fee is non-refundable, and applying before you've held settled status for 12 months will result in a refusal. A refusal also creates a permanent record that may invite additional scrutiny on future applications.

Check your settled status grant date carefully and count forward 12 full months before submitting.

Important: proposed rule changes

The UK Government's 2025 Immigration White Paper has proposed extending the standard qualifying period for settlement from 5 years to 10 years. While details are still subject to consultation, EU nationals who are already eligible should consider starting their citizenship journey under the current rules.
