Can my adult dependant apply for British citizenship immediately after ILR?

Short answer: No. Your adult dependant must hold ILR for at least 12 months before they can apply for British citizenship — unless they are married to a British citizen.

This is one of the most common questions in UK immigration groups, and the confusion is understandable. Getting ILR feels like the finish line, but for citizenship, there's one more waiting period.

The 12-month rule

Once your adult dependant receives Indefinite Leave to Remain, they must hold it for a minimum of 12 months before submitting a citizenship application. This applies whether they received ILR through the standard five-year route, as a dependant on your visa, or through the EU Settlement Scheme (settled status).

The clock starts from the date ILR was granted — not from when they first entered the UK or when they applied for ILR.

The one exception: married to a British citizen

If your adult dependant is married to (or in a civil partnership with) a British citizen, they can apply for citizenship immediately after receiving ILR. There is no 12-month waiting period in this case.

However, they still need to meet all other requirements: the Life in the UK test, English language requirement, good character, and the residency rules (3 years of UK residence for spouses, with no more than 270 days absent and no more than 90 days absent in the final year).

Other requirements your dependant must meet

Even after waiting 12 months, your dependant must also satisfy:

  • 5 years of continuous UK residence before the application date (3 years if married to a British citizen)
  • Physically present in the UK on the exact date 5 years before the Home Office receives the application
  • No more than 450 days absent from the UK during the 5-year qualifying period (270 days for spouses)
  • No more than 90 days absent in the 12 months before applying
  • Good character — no serious criminal convictions or outstanding tax issues
  • Life in the UK test — passed (if they already passed it for their ILR application, they do not need to retake it)
  • English language requirement — met at B1 level or above

What happens if they apply too early?

Submitting a citizenship application before the 12-month ILR holding period is complete will almost certainly result in a refusal. The Home Office does not hold applications until eligibility is reached — they simply refuse them. This leaves a permanent refusal on record, which could attract extra scrutiny on future applications.

The application fee for British citizenship is currently £1,630, which is non-refundable even if refused. Timing your application correctly is essential.

Practical timeline

Here's what a typical timeline looks like for an adult dependant:

  1. Year 0–5: Living in the UK on a qualifying visa as a dependant
  2. Year 5: Granted ILR
  3. Year 6: Eligible to apply for British citizenship (12 months after ILR)
  4. Year 6–6.5: Application processing (typically 3–6 months)
  5. After approval: Attend citizenship ceremony within 3 months
  6. After ceremony: Apply for British passport

Important: proposed changes

The UK Government's 2025 Immigration White Paper proposed extending the qualifying period for ILR from 5 years to 10 years. If implemented, this would significantly extend the overall timeline to citizenship. If your dependant is currently approaching 5 years of residence and is eligible for ILR under current rules, it may be worth applying sooner rather than later.
